Agreement on Responsibility for Travel and Accommodation Costs
This Agreement is made between Eclipse Recruitment Driving Solutions Ltd ("the Company") and the applicant or worker ("the Worker").
1. Purpose
The Company may, at its discretion, arrange and pay for flights, rail travel, ferries, taxis, hire vehicles, accommodation and other reasonable travel-related expenses ("Travel Costs") on behalf of the Worker in connection with assignments, events or tours.
2. Worker's Responsibilities
The Worker agrees to:

Attend all booked flights, transport and accommodation check-ins at the required times.

Provide accurate personal information required for bookings.

Comply with all travel instructions issued by the Company.

Conduct themselves professionally when representing the Company.

Perform all duties with reasonable care, skill and diligence.

Comply with all lawful instructions, workplace rules and applicable legislation.
3. Liability for Travel Costs
The Worker agrees to reimburse the Company for any Travel Costs incurred on their behalf where those costs arise directly as a result of the Worker's own actions, omissions or negligence, including (but not limited to):

Failing to attend or missing a flight, train, ferry or other booked transport.

Failing to arrive at the departure point or accommodation on time.

Cancellation or amendment charges resulting from the Worker's actions.

Additional accommodation, transport or repatriation costs caused by the Worker.

Being removed from, dismissed from or withdrawn from an assignment, event or tour due to misconduct, negligence, breach of Company rules or unacceptable behaviour.

Any additional costs reasonably incurred by the Company in replacing the Worker or returning them home following such removal.
The Worker further agrees that:

Any fines, fixed penalty notices, parking charges, toll charges, congestion charges or other penalties incurred whilst driving or using a vehicle during an assignment shall be the sole responsibility of the Worker who was in control of the vehicle at the time of the offence or contravention. Where the Company pays any such amount on the Worker's behalf, or incurs an administration charge in dealing with the matter, the Worker agrees to reimburse the Company in full.

If the Worker chooses to terminate an assignment or booking early, or voluntarily returns home before the agreed completion date, other than with the prior written agreement of the Company or due to circumstances beyond the Worker's reasonable control, the Worker shall be responsible for all additional travel, accommodation, cancellation, amendment and associated costs arising from that early departure.
The Worker will not be responsible for costs arising solely from circumstances beyond their reasonable control, including cancellations by the carrier, severe weather, government travel restrictions, or where the Company instructs the Worker not to travel.
4. Reimbursement
Where costs become payable under this Agreement:

The Company will provide the Worker with written details of the costs incurred.

The Worker agrees to reimburse the Company within 7 calendar days of receiving written notification.

Where permitted by law, the Worker expressly authorises the Company to deduct any outstanding sums from salary, wages, holiday pay, expenses, commission or any other monies due to the Worker under section 13 of the Employment Rights Act 1996 or any subsequent legislation.
If any balance remains outstanding after termination of employment or engagement, the Worker agrees that the amount shall remain payable as a civil debt.
5. General
Nothing in this Agreement affects the Worker's statutory employment rights.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
This Agreement shall survive the termination of the Worker's employment or engagement to the extent necessary to recover any outstanding Travel Costs.
This Agreement shall be governed by and construed in accordance with the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
Acceptance
By agreeing this Agreement, the Worker confirms that they have read and understood its contents and agree to be legally bound by its terms.
